Minutes: The following were present at the hearing:
Members of the Licensing (2003 Act) Sub-Committee was asked to consider and determine an application for a review of the premises licence for:
Cart and Horses, 1 Maryland Point, Stratford, E15 1PF
and any valid representations that had been made.
Mr John Chislett presented the report and advised the Sub-Committee that a review application had been submitted by the Metropolitan Police Licensing team and received by the Local Authority’s Licensing Team on 25 October 2011. The grounds for the review were on the licensing objectives of Prevention of Crime and Disorder, and the Prevention of Public Nuisance.
Mr Chislett outlined the representations that had been received in respect of the application and the premises history.
Mr Dadds, on behalf of the applicant, said that the applicant had been in discourse with the Police since the original hearing on December 2011 on ensuring that the premises’ operations promoted the licensing objectives. Further to this discourse, the applicant had proposed a number of conditions, which were submitted to Members of the Sub-Committee during the hearing.
Mr Chislett asked Mr Dadds about the location of the designated drinking area of the premises. Mr Dadds said that the applicant would, in discussion with the Police, establish the location within 21 days but that it would, in essence, be at the existing outside area at the rear of the premises.
Members asked whether issues around security that were referred to at the original hearing had been resolved. Mr Dadds said that this issue had been resolved shortly after the original hearing.
There being no further statements or questions, the Licensing Sub-Committee resolved to exclude all parties and officers to allow for a deliberation in private at 10.25am. The Clerk and legal representative remained.
All parties returned at 10.55am for the decision of the Sub-Committee.
Decision
Members of the Licensing (2003 Act) Sub-Committee were asked to hear and determine an application for the review of the Premises Licence for:
Cart and Horses, 1 Maryland Point, Stratford, E15 1PF
The review application was submitted by the Metropolitan Police Licensing team as a responsible authority on the grounds of prevention of crime and disorder and prevention of public nuisance.
Following joint submissions from the parties proposing various conditions by consent, the Sub-Committee do not consider it necessary to revoke the licence as they consider that the imposition of conditions would promote the relevant licensing objectives and therefore impose the following conditions:
