Following introductions, the Chair welcomed everyone to the meeting and explained the procedure to be followed.

Ms Uyran, the Applicant’s Agent, advised the Hearing that the Applicant, Mr Edwin Boachie, was currently abroad and was schedule to return in the next two weeks. Ms Uyran requested that the Hearing be adjourned.  Following questions from the Sub Committee and Ms Meet, Legal Advisor, Ms Uyran advised the Sub - Committee that she was only informed of Mr Boachie’s trip the previous day. The Sub-Committee was advised that Mr Boachie had taken the trip because of an emergency. Ms Uyran was unable to disclose why the trip made by Mr Boachie was considered as an emergency.

 

Ms Meet advised the sub committee they had the power to adjourn the hearing if they considered it was in the public interest to do so. The members considered the application and given the lack of information provided as to why Mr Boachie had to leave the country the members decided to proceed with the hearing.

 

Members of the Licensing (2003 Act) Sub-Committee was asked to consider and determine an application to for a new premises license for:

 

39 Balaam Street, Plaistow, London, E13 8EB and any valid representations made.

 

Mr Hunt presented the report and advised the Sub-Committee that an application for new premises licence had been received by the Licensing Authority on 28 June 2012.  The application was for:

 

 

Supply of alcohol (Off the premises)

  • Monday to Sunday 10.00 hours to 23.00 hours the days following

 

Premises Opening and Closing Times

  • Monday to Sunday 10.00 hours to 23.00 hours the days following

 

There were no questions to Mr Hunt.  Ian McConnell, ASB and Nuisance Officer, LBN, made representations against the application, on the licensing objectives of the Prevention of Pubic Nuisance, referring to their report, outlined on pages 27 & 28 of the agenda. 

 

There were no questions to Mr McConnell.

 

PC Darren Bull, Police Licensing and Enforcement Officer, Newham Metropolitan Police, made representations against the application, on the licensing objective of the Prevention of Crime and Disorder and Prevention of Pubic Nuisance, referring to their report, outlined on pages 29, 30 & 31 of the agenda. 

 

There were no questions to PC Darren Bull.

 

Applicant's Case:

 

Ms Wendy Williams advised the Sub-Committee that the premises were located on a busy road and that there were numerous shops in the vicinity which currently sold alcohol. Ms Wendy advised that her premises had been visited by officers from Food and Hygiene Agency, Health and Safety Agency and the Fire Department. Ms Williams advised that food stored in the premises, which were referred to by PC Bull in his submission was for domestic use.
