Minutes: Following introductions, the Chair welcomed everyone to the meeting and explained the procedure to be followed. The following were present at the hearing:
Members of the Licensing (2003 Act) Sub-Committee was asked to consider and determine an application to review the premises license for:
Barking Bills, 576 Barking Road, E13 9JU and any valid representations made.
Mr Grant presented the report and advised the Sub-Committee that the review application was submitted by the Licensing Authority, as a responsible authority and received by the Licensing Enforcement Team on 4 June 2012 on the licensing objective of Prevention of Crime and Disorder.
Mr Grant referred the premises history, making reference to the previous review held on 2 November 2011.
Mr Grant informed that a letter from the Metropolitan Police, in support of the review, had not been seen by Mr Aydin until this morning. He advised that part of the letter contained information outside remit of the review.
A copy of the letter was passed to Ms Burgess, Legal Advisor and the applicant. Mr Aydin gave permission to circulate to the Sub-Committee.
Ms Burgess advised the Sub-Committee to disregard the matters that go beyond the scope of the review.
Mr Aydin asked who was responsible for displaying the review posters near his shop. Mr Grant replied the licensing team, to make residents aware of the review and how to make representations.
Mr Aydin said that only 2 posters were displayed for his last review; this year there were 5. Mr Grant advised that the Licensing Officers can display as many as they wish.
Mr Aydin wanted to know who were the officers, he had witnessed ‘hanging around’ his shop; was it a Police Officer.
Colin Hunt, Licensing Authority verbally confirmed their representations against the application, on the licensing objective of Crime and Disorder.
DC Karen Cawdery, Metropolitan Police Licensing team, verbally confirmed their representations against the application on the licensing objective of Crime and Disorder, referring to letter tabled at the meeting.
The Chair asked Mr Hunt had the licensing team ever visited the premises after 23:00 and refused service. Mr Hunt replied not as far as he was aware.
Mr Aydin asked Mr Hunt to confirm that most of the incidents referred to happened last year, with the exception of one that occurred at 23:16. Mr Hunt confirmed this.
Mr Aydin said the last incident occurred 15 minutes past the permitted hours, and was made by mistake. Mr Hunt said that the test purchase on 29 June proved that he sold alcohol past his permitted hours. Mr Aydin said it was only 15 minutes past.
Mr Aydin referred to his pace interview and showed the Sub-Committee an alarm clock.

Mr Hunt presented the report and advised the Sub-Committee that application for an new Premises Licence had been received by the Licensing Authority on 2 July 2012. The application was for:
Supply of alcohol (On and Off the premises)
Recorded Music
Premises opening and closing times
There were no questions to Mr Hunt.
Councillor Winston Vaughan, local councillor and interested party, verbally confirmed his representations against the application on the licensing objectives of the Prevention of Crime and Disorder, Public Safety and the Prevention of Public Nuisance as outlined on page 53 of the agenda.
Councillor Vaughan added that this was bought to his attention by local resident. He said that the area is noted for anti-social behaviour. The use of the basement for drinking was a cause for concern. He believed it would also be harmful to public safety as there was no fire exit. In response to a question from Councillor Baikie, Councillor Vaughan said that he had not gained access to the premises, but had viewed it from outside. Irene Poole, local resident addressed the meeting, objecting to the application. Ms Poole explained that there were 3 shops and a Pub in the area, which should be enough. She said that the hours were excessive; with added music, she believed this would be a nuisance.
PC Darren Bull, Metropolitan Police Licensing team, verbally confirmed their representations against the application on the licensing objective of Crime and Disorder, outlined on pages 49 and 50 of the agenda. The Chair asked if the owner had attempted to open discussions with the licensing team, in terms of conditions. Mr Hunt said that they had not. George McDougal, Trading Standard Officer, verbally confirmed their representations against the application on the licensing objective of Protection of Children from Harm, referring to their letter outlined on pages 51 and 52 of the agenda.
There were no questions to Mr McDougal. The applicant stated that their application mentioned that they would not sell to people underage and they were fully aware of the law. Mr McDougal said there was no mention of Challenge 25 Policy.
