Members of the Licensing (2003 Act) Sub-Committee was asked to consider and determine a variation to an existing license for:

 

Barking Bills, 576 Barking Road, E13 9JU and any valid representations made.

 

Mr Orton presented the report and advised the Sub-Committee that application to vary the existing Premises Licence had been received by the Licensing Authority on 14 June 2012.  The application was for:

 

Supply of alcohol (Off the premises)

 

  • Monday to Saturday 08.00 hours to 03.00 hours the day following, an increase of 4hrs per day
  • Sunday 08.00 hours to 03.00 hours the day following, an increase of 6½ hrs

 

Premises opening and closing times

 

  • Monday to Saturday 08.00 hours to 03.00 hours the day following

 

Mr Orton confirmed that the premises were in a Cumulative Impact Zone (CIZ) and that that the applicant had been made fully aware of what was required in the operating schedule.

 

DC Karen Cawdery, Metropolitan Police Licensing team, verbally confirmed their representations against the application on the licensing objective of Crime and Disorder, outlined on pages 27 and 28 of the agenda.

 

The Applicant Mr Aydin asked how many licensed 24 hours premises were within 100 metres of his shop.  DC Cawdery advised of 2.  Mr Aydin said there were 3, including a petrol station and a Sainsbury’s.

 

Mr Aydin asked if any complaints had been made regarding the other 24 hour licensed premises.  DC Cawdery said that a number of complaints had been received, but this was not relevant to the application.

 

The Chair advised that Sub-Committee would take this on board.

 

Colin Hunt, Licensing Authority verbally confirmed their representations against the application, on the licensing objective of Crime and Disorder, referring to their letter, outlined on page 29 of the agenda. 

 

Mr Aydin referred the test purchase on 29 June 2012 and asked why no time had been recorded in the representation. Mr Hunt advised that alcohol was sold passed the permitted hours.

 

Mr Aydin said it was only 15 minutes past. Chair advised that this made no difference as it was after the permitted hours.

 

Mr Aydin said that last year’s 1 month suspension had resulted in a loss of customers he had built up over 12 years.  Mr Aydin asked why no officers visited his shop after the suspension. 

 

Mr Orton advised that he had visited the premises following the suspension.  He also re-called Mr Aydin visiting his office stating that he understood the conditions on the license.  He added that under the Licensing Act, there was no obligation to advise when to reopen the premises.

Mr Orton presented the report and advised the Sub-Committee that application to vary the existing Premises Licence had been received by the Licensing Authority on 14 June 2012.  The application was for:

 

Supply of alcohol (On the premises)

  • Sunday – Thursday 11:30 - 02:00 the following day
  • Friday and Saturday 11:30 – 04:00 the following day

 

Live Music (Indoors)

  • Every Day from 19:00 – 02:30 the following day

 

Recorded Music (Indoors)

  • Sunday – Thursday 11:30 – 02:30 the following day
  • Friday and Saturday 11:30 – 04:30 the following day

 

Performance of dance

  • Friday Saturday and Sunday 11:30 – 02:00 the following day

 

Provision of facilities for dance

  • Sunday 19:00 – 02:00 the following day
  • Thursday 22:00 – 02:00 the following day
  • Friday and Saturday 21:00 – 04:30 the following day

 

Late night refreshment

 

  • Sunday – Thursday 23:00 – 02:30 the following day

Mr Orton confirmed that the premises fell within the CIZ.  In response to a question from Councillor Crawford, Mr Orton confirmed that he had, when discussing the TENS application, explained to Mr Campbell the implications of CIZ.

 

Mr Orton also confirmed Appendix G as the current layout for the premises.  Mr Campbell said that it was an open space with moveable furniture.

 

DC Karen Cawdery on behalf of PC Darren Bull, Metropolitan Police Pro-Active Licensing team, verbally confirmed their representations against the application on the licensing objective of Crime and Disorder and Public Nuisance, outlined on pages 69 and 70 of the agenda.

 

DC Cawdery advised that since making the original representations, the Police have met with the applicant and have agreed a series of conditions.  The Clerk circulated the list of conditions to the Sub-Committee.

 

She explained a misunderstanding that occurred on 29 July 2012, whereby the applicant, on receipt of notification for hearing assumed permission was already granted. The small incident occurred, mainly ‘pushing and shoving’, which was easily dealt with and not a recordable offence.

 

Councillor Crawford asked DC Cawdery how many patrons were expected at the restaurant/bar.  DC Cawdery was unable to answer. She confirmed the revised licensable activities times allowed 30 minutes ‘consuming time’ before closure.
