Minutes: Following introductions, the Chair welcomed everyone to the meeting and explained the procedure to be followed. The following were present at the hearing:
Members of the Licensing (2003 Act) Sub-Committee was asked to consider and determine an application for a new premises license for:
Peri Peri Original, 799 Romford Road E12 1AG and any valid representations made.
Mr Orton presented the report and advised the Sub-Committee that application for new premises licence had been received by the Licensing Authority on 30 May 2012. The application was for:

There were no questions to Mr Orton.
Thomas Leeming, Newham Planning Services, made representations against the application on the licensing objective of Crime and Disorder and Public Nuisance, referring to their report, outlined on page 21 of the agenda.
There were no questions to Mr Leeming.
Ian McConnell, ASB and Nuisance Officer made representations against the application, on the licensing objective of Crime and Disorder and Public Nuisance, referring to their report, outlined on page 23 of the agenda. Mr McConnell also circulated copies of photographs taken of the rear of the premises, showing the accumulation of waste.
There were no questions to Mr McConnell.
Mr Khan the Applicant addressed the meeting. He said in relation to the licensing objectives representations, that the premises had 8 CCTV cameras. Customers would be asked politely to keep noise to minimum when leaving the premises. With regards to littering, a member of staff regularly goes out to pick up and clear littler.
He accepted that rubbish was present when Mr McConnell visited the premises, but this has since been removed and could provide pictures as evidence.
He added that there were other premises nearby that have late licences up to 1/2 am. He was only asking for an extension for the weekends. He said that it was currently Ramadan, and they have been unable to serve customers, which was having an impact on their business.
The Chair asked if he had a trade waste agreement, if so why the rubbish had acuminated.
Mr Khan said that they had an agreement with LBN for a weekly collection. Boxes would be flattening out and held in the back of garden awaiting collection.
There being no further statements or questions, the Licensing Sub-Committee resolved to exclude all parties and officers to allow for a deliberation in private at 10.23 am. The Clerk and legal representative remained.
All parties returned at 10.33 for the decision of the Sub-Committee.

27 Romford Road Stratford London E15 4LJ Application for a Time Limited premises licence was received by the Licensing Authority on the 20th June 2012. Additional documents:

Members of the Licensing (2003 Act) Sub-Committee was asked to consider and determine an application for Time Limited premises license for:
27 Romford Road, Stratford, E15 4LJ and any valid representations made.
Mr Orton presented the report and advised the Sub-Committee that application for Time Limited premises license had been received by the Licensing Authority on 20 June May 2012. The application was for:
Mr Orton explained that there was a problem with the original application, which was re-submitted on 14 July 2012.
There were no questions to Mr Orton.
DC Paul Fawcett outlined the representations of the Metropolitan Police Licensing Team on the licensing objectives of the Prevention of Crime and Disorder, referring to their letter outlined on page 51 of the agenda.
The Chair asked DC Fawcett why they objected to these particular premises.
DC Fawcett replied that the premises were within the CIZ, which had a particular problem with street drinkers. He acknowledged that the premises would not be selling alcohol. By opening later, the premises would attract people to congregate outside.
He said that during the last weekend, there were 3 violent disorder incidents from street drinkers in that area. He added that if the application were to be granted, they would wish a number of heavy conditions to be applied.
The applicant said that as a local resident, he was aware of various nearby premises with later licences.
DC Fawcett acknowledged that some nearby premises had late licenses, which were causing public disturbances and police concern. The Police were trying to deal with this problem, and if necessary, bring up for review.
The applicant asked if the Community Police Officers, seen patrolling the area could act as a deterrent. He said that they feel that they have been singled out.
Applicants Case
The applicant said that they hoped to attract passers by. They do not sell alcohol, have CCTV on the premises, and are determined to keep drinkers away from the premises. They had lost money as they were unable to trade during the Olympic Games.
The Chair pointed out that as the application was time limited until September, and asked if the applicant was considering applying for a permanent late license. The Applicant replied that this would not happen.
In response to the Applicant’s comment on loss of business during the Olympic Games period, the Chair advised that the profits anticipated from local business did not happen.
